1. The deal
Drishti is a subscription service that generates AI-rendered, brand-locked product imagery from a single reference upload. We score every output before it ships; if it drifts below our fidelity threshold, we refund the credit. We bill in Indian rupees through Razorpay (or US dollars through Stripe for overseas customers), invoice with GST where applicable, and operate under the DPDP Act 2023 and the rest of Indian law.
By creating an account you accept these Terms and the Privacy Notice. If you don't accept them, don't use the service. If you're using it on behalf of a company, you're confirming you have the authority to bind that company.
2. Account + workspaces
An account belongs to one human being. Team collaboration happens through the workspace: the owner invites members by email, each gets their own credentials, and each has a role (owner, admin, member, viewer). Sharing credentials is not collaboration — it's a security incident, and it voids the fidelity SLA for the duration of the shared session.
Workspaces are tenant-isolated: data, brand vaults, and generations from one workspace are never readable by another, including by us during routine operations. The only exceptions are explicit support sessions you authorise from Workspace settings → Support access, which are time-boxed and logged.
3. Fair use + credits
Each tier ships with a monthly credit allowance (the exact count is on the pricing page). One verified generation = one credit. Credits reset on the billing-cycle anniversary and do not roll over after cancellation — they expire at the end of your final paid month.
Refunds for low-fidelity generations are automatic: outputs scoring below 75 never enter your allowance and you see no charge at all. Tier caps and per-second rate limits exist to keep the Gemini pool fair across the cohort; if you consistently hit them, House or Enterprise will give you priority queue access.
4. What you own + what we own
You own what you upload: your product photographs, logos, palette references, and packaging artwork remain your property, unencumbered. You also own the generated outputs — Drishti grants you a perpetual, worldwide, royalty-free, sub-licensable licence to use them for any lawful commercial purpose, including resale, modification, and inclusion in derivative work.
We own the platform itself — the verifier stack, the prompt-engineering scaffold, the UI, the mode recipes, and the underlying scoring models. You may not extract, reverse-engineer, or rebuild the verifier from outputs alone. The boundary is clean: the pictures are yours, the factory is ours.
5. Prohibited use
You agree not to use Drishti to do any of the following, and we will suspend an account on a single confirmed violation:
- Generating deepfakes of real, identifiable people without their written consent on file.
- Producing imagery for product categories prohibited or restricted under Indian law (narcotics, unlicensed firearms, items barred under the Drugs and Cosmetics Act).
- Generating sexual content involving minors, or any imagery that depicts a minor in a commercial product context.
- Attempting to extract training data, model weights, or proprietary prompt logic from the platform.
- Scraping, automated browsing, or DOM-level enumeration of other workspaces' generations.
- Producing imagery that infringes a third party's trademark, design right, or registered get-up without licence.
- Generating misleading medical, financial, or legal claims on packaging or labels.
- Bypassing or interfering with the C2PA / IPTC AI-disclosed metadata we attach to every output.
- Reselling raw Drishti API access as a competing service, or routing third-party prompts through your account.
- Using the service to harass, defame, or generate content targeting an individual or a protected community.
6. Brand-fidelity guarantee
Every generation is scored 0–100 by a separate verifier stack (DINOv2 + SAM-2 + PaddleOCR + ΔE-2000, with a Gemini judge). The score determines what happens next:
- Below 75 — auto-refund. The credit is returned the same second; the output is not shipped to your workspace. You see a short reason in the timeline.
- 75 to 89 — ships with a warning chip. The output enters your library flagged amber. You can use it; you can also regenerate without a fresh charge if you do so within five minutes.
- 90 and above — ships with the gold ring. The output is considered campaign-ready and the score appears on the C2PA manifest.
Refunds are immediate, full, and never partial. We do not offer refunds on outputs that scored above 75 — the threshold is objective and the same for every customer.
7. Payments + GST
Indian customers are billed in INR through Razorpay; overseas customers may opt for USD through Stripe. The first charge happens on activation; subsequent charges fire on the same calendar day each month until you cancel. Invoices land in your billing inbox within one business day of each charge.
GST is charged inclusively for Indian buyers at the rate applicable to your state of registration, and exclusively for export of services (zero-rated under the IGST Act with a Letter of Undertaking on file). Every invoice carries HSN code 998314 (IT services), your GSTIN where supplied, our GSTIN, and a cryptographic invoice signature compatible with the IRP e-invoice scheme above the turnover threshold.
8. Termination
Either party can end this agreement at any time. You can cancel from Workspace settings → Billing; we can cancel for cause (prohibited use, payment failure after three retries, breach of these Terms) on written notice. On cancellation: no refund for the current month, no future charges, and you lose access at the end of the period you paid for.
Workspace data — vaults, generations, prompt history — is retained for 30 days after cancellation so you can restore the account if you change your mind. On day 31 it is permanently deleted from primary storage and purged from backups within a further 30 days. The audit log is retained for 7 years regardless of cancellation, as Indian law requires.
9. Liability
Our maximum aggregate liability to you, for any cause of action arising from your use of Drishti, is capped at the total fees you have paid us in the twelve months immediately preceding the event giving rise to the claim. We do not exclude liability where Indian law does not permit it — including for death, personal injury, fraud, or wilful misconduct.
We are not liable for consequential losses: lost profits, lost goodwill, lost campaign opportunity, or the cost of substitute services. This agreement is governed by the laws of India, and the courts of Mumbai, Maharashtra have exclusive jurisdiction over any dispute that is not resolved through the process in §10.
10. Disputes + changes
Before any litigation, please write to admin@indigenservices.in describing the dispute. We commit to a 30-day cure period in which we will work with you to resolve the matter, including good-faith mediation under the Mediation Act, 2023 if either party requests it. Litigation may be filed only after this period has lapsed without resolution.
We may update these Terms as the platform evolves. Any change that reduces your rights — a longer notice period for cancellation, a tighter refund window, a narrower IP licence — is notified by email and an in-app banner at least 30 days in advance. Other changes (typo fixes, clarifications, new beta-only features) take effect when published, with the changelog at /legal/terms/changelog.
